Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Kitabi mobile application and related services (collectively, "Kitabi" or the "Service"). Kitabi is operated by Zani Dobruna, based in Belgium ("we", "us", or "our"). By downloading, installing, or using Kitabi, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Kitabi. If you are under the age of majority in your jurisdiction (16 in most of the EU), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
2. Your account
Some features require an account. You agree to provide accurate information, keep your credentials confidential, and take responsibility for all activity under your account. Notify us promptly at kitabidev@gmail.com if you suspect unauthorized access. You may delete your account at any time from within the app (Profile → Delete Account).
3. Subscriptions and payments
Kitabi offers optional paid subscriptions ("Kitabi Premium") that unlock additional features. Subscriptions are sold and managed through the Apple App Store and are billed to your Apple ID. Current pricing is shown in the app before purchase.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. Your Apple account will be charged for the renewal at the then-current price.
- Free trials: If we offer a free trial, it converts to a paid subscription at the end of the trial period unless you cancel before it ends. Any unused portion of a free trial is forfeited on purchase of a subscription.
- Managing or cancelling: You can manage or cancel subscriptions in your iPhone or iPad Settings → your Apple ID → Subscriptions → Kitabi. Cancelling stops future renewals but does not refund the current billing period.
- Refunds: All refunds are handled by Apple under Apple's refund policy. Request a refund at reportaproblem.apple.com. We do not issue direct refunds.
- Price changes: If we change subscription pricing, the new price applies to the next billing cycle. Apple will ask you to reconfirm material increases before they take effect.
4. Acceptable use
When using Kitabi, you agree not to:
- violate any law or the rights of others;
- impersonate another person, misrepresent your identity, or harass other users;
- upload, import, or share content that is illegal, abusive, or infringes on someone else's rights;
- attempt to reverse-engineer, decompile, or bypass security features of the app;
- scrape, data-mine, or use automated tools to access the Service at scale;
- resell, sublicense, or commercially exploit the Service without our written consent.
5. User content
You retain ownership of content you create within Kitabi (e.g. saved words, notes, imported text from URLs you provide). You grant us a limited, worldwide, royalty-free licence to store and process that content solely to operate the Service for you (e.g. syncing your progress, generating flashcards, providing AI assistance). You are responsible for ensuring you have the right to import any third-party content into the app.
6. Intellectual property
The Service, including all code, text, graphics, layouts, audio, curated vocabulary and reading content, trademarks, and logos, is owned by us or our licensors and is protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Kitabi for your personal, non-commercial language learning. All rights not expressly granted are reserved.
7. Third-party services and content
Kitabi integrates third-party services (e.g. AI tutors powered by external providers, voice synthesis, authentication, analytics). Your use of those features is also subject to the relevant third-party terms. We are not responsible for the accuracy, availability, or output of third-party services. AI-generated explanations may be incorrect and should not be relied on as authoritative sources for religious, academic, legal, or medical matters.
8. Privacy
Your use of Kitabi is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
9. Disclaimers
Kitabi is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that learning outcomes will match your expectations.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim, or EUR 50, whichever is greater. Nothing in these Terms limits liability that cannot be limited by applicable law (e.g. consumer protection rights in the EU).
11. Termination
You may stop using Kitabi at any time and delete your account from the app. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. On termination, sections that by their nature survive (payment, intellectual property, disclaimers, limitation of liability, governing law) will remain in effect.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the app or by updating the "Last updated" date above. Continued use of the Service after an update constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and delete your account.
13. Governing law and disputes
These Terms are governed by the laws of Belgium, without regard to its conflict of laws rules. You and we agree that any dispute will be subject to the exclusive jurisdiction of the courts of Brussels, Belgium, except that if you are a consumer resident in the European Union, you retain the benefit of any mandatory consumer protection rules in your country of residence.
